These Terms & Conditions ("Terms") govern your access to and use of the GiftPe website, mobile application and related services.

GiftPe is operated by Zapnity Services OPC Private Limited, having its address at:

First Floor, Dhakad Plaza, Sheel Nagar, Sagartal Road, Sabda Pratap Ashram, Bahodapur, Gwalior, Madhya Pradesh – 474012.

By accessing or using GiftPe, you agree to these Terms.

If you do not agree with these Terms, please do not use GiftPe.

1. About GiftPe

GiftPe is a digital platform through which users can discover and purchase discounted gift cards and digital vouchers from participating brands.

Gift cards and vouchers may be made available through authorised distribution, fulfilment or technology partners, including Gullak Technologies Private Limited.

2. Eligibility

You must:

• Provide accurate information;

• Have the legal capacity to enter into a binding agreement;

• Use GiftPe only for lawful purposes;

• Comply with these Terms and applicable laws.

3. User Account

Certain features may require an account.

You are responsible for:

• Maintaining the confidentiality of your account;

• Providing accurate information;

• Keeping your registered mobile number/email updated;

• All activity carried out through your account, subject to applicable law.

You must immediately notify us if you believe your account has been accessed without authorization.

4. Gift Card Purchases

Gift cards and vouchers displayed on GiftPe may have:

• Different denominations;

• Different discounts;

• Different validity periods;

• Different redemption methods;

• Online and/or offline redemption restrictions;

• Brand-specific terms and conditions.

These details may vary from one brand to another.

You should carefully review the applicable terms before purchasing.

5. Prices and Discounts

GiftPe may offer gift cards at prices lower than their face value.

For example, a ₹1,000 gift card may be available at a discounted purchase price.

The applicable price shown at checkout will be the price payable by you.

Discounts may vary based on:

• Brand

• Denomination

• Promotional campaign

• Availability

• User eligibility

• Time period

GiftPe may modify or discontinue discounts without prior notice, subject to applicable law.

6. Payment

Orders must be paid through the payment methods made available on GiftPe.

An order is considered successful only after payment has been successfully confirmed and the voucher has been successfully issued/fulfilled.

A payment deduction without successful order fulfilment does not necessarily mean that the voucher has been issued.

7. Digital Delivery

Gift cards and vouchers are digital products.

Following successful payment and fulfilment, the voucher may be delivered through the GiftPe application, account, registered mobile number, email or another electronic method.

8. Redemption

Gift cards and vouchers must be redeemed according to the applicable brand's instructions.

The following may vary:

• Redemption location

• Minimum purchase value

• Validity

• Partial redemption

• Multiple-use redemption

• Online/offline redemption

• Product/category restrictions

• Other restrictions

The respective brand's terms will apply to redemption.

9. No Cash Conversion

Unless expressly permitted by the issuing brand or applicable law, gift cards/vouchers:

• Cannot be exchanged for cash;

• Cannot be transferred to a bank account;

• Cannot be converted into cash;

• Cannot be used for unauthorized purposes.

10. Prohibited Activities

You must not:

• Use GiftPe for unlawful activities;

• Attempt to commit fraud;

• Use stolen payment methods;

• Create accounts for fraudulent purposes;

• Manipulate offers or discounts;

• Attempt unauthorized access;

• Reverse engineer or interfere with the platform;

• Resell vouchers where prohibited;

• Abuse promotional campaigns.

GiftPe may suspend or terminate accounts involved in suspected fraud or abuse, subject to applicable law.

11. Third-Party Brands

GiftPe does not control the products, services, policies or operations of third-party brands.

Gift cards remain subject to the relevant brand's terms and conditions.

12. Intellectual Property

All GiftPe branding, logos, software, designs, text, graphics and other platform content are owned by or licensed to Zapnity Services OPC Private Limited unless otherwise stated.

You may not reproduce, distribute, modify or commercially exploit GiftPe content without permission.

13. Service Availability

We aim to keep GiftPe available and functional but do not guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable due to:

• Maintenance

• Technical issues

• Partner systems

• Network failures

• Payment failures

• Force majeure events

14. Limitation of Liability

To the extent permitted by applicable law, GiftPe will not be liable for losses arising from:

• Incorrect information provided by the user;

• Incorrect redemption of a voucher;

• Expiry of a voucher;

• Brand-level refusal to accept a voucher where permitted under its terms;

• Third-party system failures;

• Unauthorized access caused by the user's failure to secure their account;

• Events beyond our reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded.

15. Suspension or Termination

GiftPe may suspend or terminate access where there is reasonable evidence of:

• Fraud

• Abuse

• Violation of these Terms

• Illegal activity

• Security threats

16. Governing Law

These Terms shall be governed by the laws of India.

Subject to applicable consumer protection laws, courts having appropriate jurisdiction in Gwalior, Madhya Pradesh shall have jurisdiction.
